Welcome to NightGridRacing. These Terms of Service ("Terms") govern your use of nightgridracing.com (the "Site") and your purchases from us. By using the Site or placing an order, you agree to these Terms.
Overview
The Site is operated by NodeAtom LLC, trading as NightGridRacing ("we," "us," "our"). Throughout the Site, the terms "you" and "your" refer to the user or customer.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Site.
Products and Pricing
We do our best to display products, colors, and specifications accurately, but we do not guarantee that your screen displays colors exactly. Garment measurements carry a manufacturing tolerance of approximately 2–3 cm; small variations are not defects. All prices are listed in US dollars and are subject to change without notice. We reserve the right to correct pricing errors, limit order quantities, or refuse any order at our discretion.
Reflective Products
Our reflective prints are retroreflective, not luminous. They return light towards its source, which means they appear as a normal print in ordinary daylight or room lighting and light up when a direct light source — such as headlights or a camera flash — strikes them. They are a visibility aid, not certified protective or high-visibility safety equipment.
Orders
When you place an order, you make an offer to purchase. We reserve the right to accept or decline any order. If we cancel an order after payment, we will issue a full refund for the affected items. Order changes and cancellations are governed by our Refund & Return Policy.
Shipping
Shipping timeframes and terms are described in our Shipping Policy. Delivery estimates are not guaranteed. Risk of loss passes to you upon delivery of the goods to you. If you are a consumer in the European Union or the United Kingdom, risk remains with us until the goods come into your physical possession, as required by law.
Returns and Refunds
Returns and refunds are governed by our Refund & Return Policy, which forms part of these Terms.
Prohibited Uses
You may not use the Site for any unlawful purpose, to infringe our intellectual property, to submit false information, to introduce malicious code, or to interfere with the Site's operation.
Intellectual Property
All content on the Site — including the NightGridRacing name, logo, product designs, text, and images — is owned by NodeAtom LLC or its licensors and is protected by intellectual property laws. You may not reproduce or use it without our written permission.
Disclaimer of Warranties
The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under the law that applies to you as a consumer.
Limitation of Liability
To the fullest extent permitted by law, NightGridRacing is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product in question. Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
Indemnification
You agree to indemnify and hold NightGridRacing harmless from any claims arising out of your breach of these Terms or misuse of the Site.
Governing Law
These Terms are governed by the laws of the State of Montana, United States, without regard to conflict-of-law principles. Consumers in the European Union and the United Kingdom keep the protection of the mandatory law of their country of residence, and may bring proceedings there.

We may update these Terms at any time. The version in force is the one published when you order.
